These Terms govern your use of the Bidatv mobile application and related services in the United States and other regions where we make the App available. Please read them carefully.
1. Acceptance
Welcome to Bidatv (“Bidatv,” “we,” “us,” or “our”). By downloading, accessing, or using the Bidatv app (the “App”), you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the App.
You must be at least 18 years of age (or the age of majority in your state, province, or country, whichever is higher) to register for or use the App. The App is not available to anyone under 18. By using the App, you represent and warrant that you meet this requirement.
The App is not directed to children. We do not knowingly permit use by, or collect personal information from, anyone under 18.
2. The Service
Bidatv is a live streaming and social interaction platform. Depending on your role and app version, features may include:
Discover & watch — browse live rooms by category, join as a viewer, follow hosts, and open profiles;
Host broadcasting — available only to users who submit a host application through the in-App channel and are approved by us; approved hosts may set a cover, title, and welcome message, broadcast, and view end-of-stream stats (duration, viewers, new followers, gems received);
Live chat — public chat, entry messages, and system notices in rooms;
Virtual gifts — viewers send gifts using in-app Coins; only approved hosts receive Gems from gifts, which are used to calculate earnings under platform rules;
PK battles — quick match or invite another host; warm-up, battle, and penalty phases; contribution rankings and history;
Guest audio — voice co-host seats (apply, invite, mute, leave); PK and guest audio may be mutually exclusive as shown in the App;
Wallet — view balances and transaction history where available;
Trust & safety — report users, host moderation tools (e.g., remove from room), system notifications, and account deletion.
We may add, change, suspend, or discontinue features at any time. The App relies on third-party real-time audio/video and messaging infrastructure; availability may vary with network conditions and provider policies.
3. Your Account
You sign in with a valid email address and a one-time verification code. You agree to provide accurate information and keep it current.
You are responsible for all activity under your account. Do not share, sell, or transfer your account.
Viewer vs. host. All registered users may watch live streams and use viewer features (e.g., chat, sending gifts with Coins). Going live is not available to every user. You must apply to become a host through the designated in-App application process. We review applications and may approve or deny them at our discretion. Only after approval do you receive host privileges (including broadcasting and a Gem balance).
We may revoke host status, suspend broadcasting, or terminate any account that violates these Terms, applicable law, or our community standards.

4. Content & Community Standards
You are solely responsible for content you create, stream, upload, or share—including video, audio, text, images, and profile information. You agree not to:
Violate any federal, state, local, or international law, or applicable platform rules;
Post sexual content involving minors, non-consensual intimate imagery, or content that exploits or endangers minors;
Promote violence, terrorism, hate, harassment, bullying, or credible threats;
Engage in fraud, scams, impersonation, or spam;
Infringe copyrights, trademarks, privacy, or publicity rights;
Interfere with the App, use bots or unauthorized automation, or attempt to reverse engineer our software;
Collect personal information about other users without their consent.
We may review reports and use automated or manual tools to enforce these standards. We may remove content, restrict features, mute users, remove users from a room, or permanently ban accounts. We may report illegal activity to law enforcement where appropriate.
5. Live Streaming, PK & Guest Audio
Host approval required. Only users with approved host status may create and manage live streams. Attempting to broadcast without approval, or circumventing the application process, is prohibited.
Permissions. Going live requires camera and microphone access. You represent that you have the rights to broadcast your content.
PK rules. Phase timing, scoring, and penalties are described in-app (e.g., “PK Rules”). Leaving a PK early may count as a loss for your side, as stated in the App.
Guest audio. Hosts control seats and may mute or remove guests. Accepting a PK invite may disable guest audio, as indicated before you confirm.
Host tools. Hosts may remove viewers from a room for violations. Removed users may be temporarily unable to rejoin.
6. Virtual Currency & Gifts
Coins may be purchased (where available) and are used by viewers to send virtual gifts in live rooms. Coins are for in-app use only. Viewer accounts do not hold Gems.
Gems are available only on approved host accounts. When viewers send gifts during your live stream, the platform credits Gems to your host account according to applicable rules. Gems are used to calculate your earnings and income settlement on the platform (including display in Wallet and earnings settlement features as described in the App). Gem balances, conversion rates, minimum thresholds, and settlement schedules are set by us and may change with notice where required.
Virtual currency, gifts, and related benefits have no cash value outside our published settlement rules, are not legal tender, and generally cannot be exchanged or transferred except as we expressly allow in writing.
Purchases processed through the Apple App Store (or other stores) are also subject to the store’s terms and refund policies. Except where required by law, all sales are final.
Because the App is limited to users 18 and older, you must not purchase Coins or use paid features unless you meet the age requirement above.
If your account is terminated for cause, unused virtual assets may be forfeited without compensation.
7. Reports & Enforcement
You may submit reports with a reason and optional screenshots. We review reports in good faith but do not guarantee a particular outcome. Hosts may moderate their rooms within applicable law and these Terms.
8. Intellectual Property
The App, including software, design, logos, and documentation, is owned by us or our licensors and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
You retain ownership of your content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute your content solely to operate, promote, and improve the Service.
9. Disclaimers & Limitation of Liability
THE APP AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE ARE NOT LIABLE FOR USER-TO-USER DISPUTES, USER CONTENT, OR ACTIONS OF HOSTS OR VIEWERS. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF (A) USD $100 OR (B) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
California residents: You may have rights under California Civil Code § 1542 regarding unknown claims. Where applicable, you waive such rights to the extent allowed by law.
10. Account Deletion
You may request account deletion in Settings → Delete Account. Deletion is permanent and cannot be undone. After deletion, you will be signed out immediately. The rules below depend on whether your account is a regular user (viewer) account or an approved host account.
10.1 Regular user (viewer) accounts
If you have not been approved as a host, or you are using the App only as a viewer, account deletion works as follows:
Your profile, follow relationships, and chat history may be deleted or anonymized;
Any Coins remaining in your account will be cleared without refund;
Unused virtual items and benefits may be forfeited;
Some information may be retained where required by law (for example, certain transaction or compliance records).
The App may show you a summary of these consequences before you confirm deletion.
10.2 Approved host accounts
If your account has approved host status, additional rules apply before you may delete your account:
Gem balance must be zero. Only host accounts hold Gems. You must reduce your Gem balance to zero through methods provided by the platform before deletion. If your Gem balance is greater than zero, the App may block deletion and prompt you to clear Gems first.
Earnings must be settled. You must fully settle all outstanding earnings related to your host activity—including completing any pending earnings settlements, resolving holds, chargebacks, or platform adjustments—so that no unpaid or unsettled host income remains on your account. We may refuse or delay deletion until settlement is complete.
After the above conditions are met, deletion may remove your profile, live-stream data, earnings records, and related host information, subject to legal retention requirements;
Any Coins in your account will be cleared without refund, as with regular users.
The in-App deletion flow and notices describe the current Gem balance and settlement status. If you have questions about settling earnings, contact 13726867419@163.com before requesting deletion.
10.3 Effect of deletion
Once deletion is processed, you cannot restore your account or recover deleted data. We may retain limited information as required by law, fraud prevention, dispute resolution, or enforcement of these Terms.
11. General Provisions
Changes. We may update these Terms by posting a revised version in the App or at our website. Material changes will be communicated through reasonable means. Continued use after the effective date constitutes acceptance.
Governing law. These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your state of residence apply.
Disputes. Except for claims that qualify for small claims court, disputes shall be resolved by binding arbitration on an individual basis under the rules of the American Arbitration Association, unless you opt out within 30 days of first accepting these Terms by emailing 13726867419@163.com with subject “Arbitration Opt-Out.” You waive class actions to the extent permitted by law.
